Summary of Cashalo Terms of Service

  1. Introduction
    By using the Cashalo Website, Mobile Application and other digital media (“Cashalo Facility”), you agree to the Terms of Service (“Terms”) of Paloo Financing, Inc. (the “Company”) found on the following link:  https://cashalo.com/terms-of-service/. 

This summary of Terms is being provided for your convenience only.  You must review, understand and agree to the full Terms of the Cashalo Facility.  

If you do not understand or agree to the Terms, please discontinue use of the Cashalo Facility.

  1. Eligibility
    To use the Cashalo Facility, you must:
  • Be at least 18 years old.
  • Be in good credit standing.
  • Have the legal capacity to enter into agreements.
  • Consent to identity verification, fraud checks and background checks.
  1. Registration and User Obligations
    By using the Cashalo Facility, you agree to provide accurate and complete information in the registration or application form.  If you do not, the Company reserves the right to cancel your registration, suspend your account, reject any application, and/or restrict your use of the Cashalo Facility.   
  2. Privacy and Data Usage
    By registering and using the Cashalo Facility, you agree that your personal information, as defined under the Data Privacy Act of 2012 (hereinafter referred to as “Personal Data”) may be collected, used and processed in accordance with the Company’s Privacy Policy, which is found in the following link:  https://cashalo.com/privacy-policy/. 

Your Personal Data may be shared with third parties, including financial institutions, fraud prevention agencies, and government bodies for legal compliance and service enhancements.

  1. User Content
  • You are responsible for any content that you share on the Cashalo Facility.
  • The Company may use your content for any purpose, including marketing or fraud prevention.
  • You must not post any illegal or infringing content on the Cashalo Facility
  • The Company is not responsible for any third-party use or misuse of your shared content on the Cashalo Facility.
  • You agree not to use a fictitious name or conceal your true identity for the purpose of concealing crime, evading the execution of a judgement, or causing damage.
  • You take sole responsibility for the consequences of your actions and interactions using the Cashalo Facility, and you will be liable to the Company for whatever loss or damage the Company may suffer as a result of your use or misuse of the Cashalo Facility.
  1. Third-Party Services and Liability
    The Cashalo Facility may include products and services offered by third-party providers. Your use of third-party products or services are subject to such third-party providers’ respective terms and conditions.  You must review the third-party terms before availing of their products and services. The Company will not be responsible for the performance or reliability of any third-party product or services.
  • If you purchase any third-party products and services available over the Cashalo Facility, the Company will not be liable for any undelivered goods and services, defects, damages and after-sales services of such goods and /or services of third parties. 
  • You shall be fully accountable for payment transactions especially in dealing with merchants that may have limited refund policy for disputes.
  1. No Warranty & Service Limitations
  • The Cashalo Facility is provided to you “as is” and “as available.”
  • The Company does not guarantee uninterrupted or error-free service.
  • The Company will not be liable for any service disruptions, inaccuracies, or third-party content issues.
  1. User Account Responsibilities
  • You are responsible for managing your Cashalo Facility’s account credentials, including maintaining its security and confidentiality.
  • You must immediately report to the Company any unauthorized use or security breach of your Cashalo Facility account.
  • The Company will not be liable for any losses you may sustain due to unauthorized access of your Cashalo Facility account.
  • The Company reserves the right to remove or reclaim any usernames at any time and for any reason, including, but not limited to claims by a third-party that a username violates the third-party’s rights.
  1. Prohibited Activities

You agree to abide by all applicable terms and conditions, laws and regulations in your use of the Cashalo Facility.

You must not:

  • Create multiple accounts.
  • Engage in fraud, impersonation, or misinformation.
  • Share harmful or offensive content.
  • Violate any intellectual property rights.
  • Attempt unauthorized access or data breaches.
  • Post unsolicited advertising or promotional materials.
  • Solicit passwords or personal information.
  • Make publicly available any personal information of third party without their consent.
  • Harvest personal information from other users.
  • Post or make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
  1. Company Reserved Rights

The Company reserves the right to:

  • Deny access to the Cashalo Facility.
  • Suspend or terminate user accounts.
  • Modify or discontinue services on the Cashalo Facility.
  • Collect, review, and share user data for fraud prevention.
  • Review or remove any information provided on the Cashalo Facility.
  • Enhance or improve the services on the Cashalo Facility.
  • Verify the truthfulness of information provided on the Cashalo Facility.
  • Set limitations to the services on the Cashalo Facility.
  • Update the Terms of Service with prior notice.
  1. Contracts and Authorizations

Your use and availment of the services on the Cashalo Facility may be conditioned on your agreement to certain contracts and authorizations (“the Agreement”).  By signing the Agreement, you agree to be bound terms and conditions thereof.

  1. Payment Channels and Automatic Debit Arrangement (ADA)

Any payments you make in connection with the Agreement shall be made through the designated banks or third parties appointed by the Company to accept payments (“Payment Channels”).

Changes to the Payment Channels will be posted in the Cashalo Facility or the webpage (https://www.cashalo.com/portfolio/where-can-I-repay-my-loan/). 

The Company shall not be liable for any delay or failure in crediting or accepting any payment resulting from any event, circumstance, fault or negligence of the Payment Channels including, but not limited to, the closure, non-functioning, or malfunctioning of the Payment Channels.

Users may opt for ADA to allow automatic payments from their nominated bank accounts. Sufficient funds must be maintained, and users can unlink their accounts by contacting Cashalo customer service hello@cashalo.com.

  1. Termination of Services
    Cashalo may terminate or suspend your access to the Cashalo Facility without prior notice of liability if you violate the Terms. 

Termination does not absolve you from any outstanding obligations you may have to the Company.

  1. Liability

Cashalo will not be liable for any damages or losses you or a third party may incur as a result of:

  • Refusal of any financial institution to allow, accept or honor the Cashalo service.
  • Service or system unavailability.
  • Delay, interruption or termination of a transaction due to external factors.
  • Third-party issues, including fraud or unauthorized transactions.
  • Losses from unauthorized use of the Cashalo Facility account.
  • Third-party fraud or misconduct.

You shall be liable for any loss or damage suffered by the Company of any of its users as a result of:

  • Your breach of the Terms of Service or any Agreement you have entered into related to the Cashalo Facility.
  • Your fraudulent use of the Cashalo Facility; and
  • Your provision of inaccurate, false or fraudulent data or information.
  1. Intellectual Property Rights
    All trademarks, logos, copyrighted work and proprietary content (Cashalo Marks) within the Cashalo Facility belong to Company or to their respective third party owners. 

You may not use, copy, or distribute any of the Cashalo Marks on the Cashalo Facility unless otherwise expressly permitted.

  1. Updates to Terms of Service
    Company may update these Terms at any time. Continued use of the Cashalo Facility after updates constitutes your agreement to the new or updated Terms.
  2. Miscellaneous

You agree that all documents or notices may be delivered to you electronically, through your e-mail address and/or mobile number provided upon registration.

Subject to applicable law, all disclaimers, indemnities and exclusions in these Terms shall survive the termination of any Agreement between you and the Company.

These Terms are governed by the laws of the Philippines, and disputes shall be settled in Pasig City courts.

  1. User Acceptance
    By registering or using the Cashalo Facility, I acknowledge and agree to the Terms.  I also expressly consent to the use and processing of my Personal Data in accordance with the terms of the Privacy Policy.

I HAVE READ THESE TERMS AND AGREE TO ALL OF THE PROVISIONS CONTAINED ABOVE AND ANY FUTURE REVISION TO THESE TERMS. 

BY CLICKING THE “SIGN UP” OR “CONNECT” OR “REGISTER” OR “SUBMIT” BUTTON OF ANY SOCIAL MEDIA OR PUBLIC PLATFORMS LINKED TO THE CASHALO FACILITY, I UNDERSTAND THAT I AM CREATING A DIGITAL SIGNATURE, WHICH I INTEND TO HAVE THE SAME FORCE AND EFFECT AS IF I HAD SIGNED MY NAME MANUALLY.
